Mode 7 Limited. (“Mode 7”) operates several websites and game software including “Frozen Synapse”, “Frozen Cortex”, “www.frozensynapse.com”, “www.mode7games.com” and “www.frozencortexgame.com”. It is Mode 7’s policy to respect your privacy regarding any information we may collect while operating our websites and game products.

Website Visitors and Game Users

Like most game developers, Mode 7 collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Mode 7’s purpose in collecting non-personally identifying information is to better understand how Mode 7’s visitors use its website. From time to time, Mode 7 may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website or game products.

Mode 7 also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on Mode 7 websites. Mode 7 only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below, except that blog commenter IP addresses and email addresses are visible and disclosed to the administrators of the blog where the comment was left.

Gathering of Personally-Identifying Information

Certain visitors to Mode 7’s websites and users of game software choose to interact with Mode 7 in ways that require Mode 7 to gather personally-identifying information. The amount and type of information that Mode 7 gathers depends on the nature of the interaction. Those who engage in transactions with Mode 7 are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, Mode 7 collects such information only insofar as is necessary or appropriate to fulfill the purpose of the user’s interaction with Mode 7. Mode 7 does not disclose personally-identifying information other than as described below.

Aggregated Statistics

Mode 7 may collect statistics about the behavior of users. For instance, Mode 7 may monitor game server usage time. However, Mode 7 does not disclose personally-identifying information other than and only to the extent as described below.

Protection of Certain Personally-Identifying Information

Mode 7 discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Mode 7’s behalf or to provide services available in Mode 7’s game products or websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Mode 7’s websites or game software, you consent to the transfer of such information to them and at all times in compliance with data laws. Mode 7 will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Mode 7 discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Mode 7 believes in good faith that disclosure is reasonably necessary to protect the property or rights of Mode 7, third parties or the public at large. If you are a registered user of an Mode 7 website and and have supplied your email address, Mode 7 may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Mode 7 and our products. We primarily use social media to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it (after removing contact details and other personally identifying information) in order to help us clarify or respond to your request or to help us support other users. Mode 7 takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Mode 7 uses cookies to help Mode 7 identify and track visitors, their usage of Mode 7 websites, and their website access preferences.

Mode 7 visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Mode 7’s websites, with the drawback that certain features of Mode 7’s websites may not function properly without the aid of cookies. Business Transfers

If Mode 7, or substantially all of its assets, were acquired, or in the unlikely event that Mode 7 goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Mode 7 may continue to use your personal information as set forth in this policy.

Analytics

We use Google Analytics to collect and process information on visitors to our websites. This service is configured to automatically delete a user’s information 26 months after their last visit to our site.
"Share" Buttons – We integrate sharing buttons and other such technology from a number of companies such as Twitter and Facebook in order to facilitate sharing our content on these services. This also means that these companies are able to track our users.

Spam Detection

We check the IP and email address of users who make comments or post on our forum against a number of blacklists such as Spamhaus, SORBS and Spamcop in order to prevent spam. We also check the content of messages using Stop Forum Spam and Akismet.

Game Server Information

We keep the following personally identifying information on our game servers: email addresses, usernames and passwords. We use the usernames and passwords to provide accounts which are necessary for the multiplayer aspects of our games. Passwords are transformed using a hashing function before being stored in our database. We use the email addresses to provide relevant notifications (e.g. challenges and new turns) and marketing messages where the player has opted to receive these messages.

Use of Email Addresses

We use the recommended practice of "double opt-in" before sending marketing messages. This means that those users have actively confirmed that they wish to receive messages from us. We also send marketing emails about Mode 7 and our games to those we have an existing business relationship with (i.e. customers who have bought our games).

We may also occasionally need to send email to users without going through the double opt-in procedure. These emails are "transactional" meaning that they are sent as a direct consequence of a user's interaction with our products.

Age Requirements

We do not ask and do not keep records of the age of our users. We require our users to be over 13 to play our games. Some of our games have an age rating certification which is enforced by the stores the games are sold on.
